Dismissal without notice

An employer can summarily dismiss an employee if the employee is in gross breach of his/her obligations or is otherwise in material breach of the employment contract. This means that the employee will not be given a period of notice and no pay from the day she/he is summarily dismissed. The employee is not entitled to remain in the position during the hearing of a dispute unless the court so rules.

In other respects, the same rules apply as for ordinary dismissals.
